INCOME TAX TREATMENT OF HUMANITARIAN ASSISTANCE
FOR THE NATURAL DISASTER
IN NANGGROE ACEH DARUSSALAM AND NORTH SUMATRA
(Regulation of the Minister of Finance of the Republic of Indonesia
Number 609/PMK.03/2004 dated 28 December 2004)
The Minister of Finance of the Republic of Indonesia,
Considering:
a. that the natural disaster in the form of an earthquake and tsunami that swept the Provinces of Nanggroe Aceh Darussalam and North Sumatra in December 2004 constitute a national disaster creating enormous loss of life and property, and therefore requires a very large amount of funds and very rapid handling;
b. that in order to handle this national disaster, the participation and concern of the entire public is needed, particularly from entrepreneurs and other Taxpayers, as a manifestation of the solidarity and unity of the Indonesian people, in the form of contributions to the victims of this natural disaster;
c. that in connection with the matter mentioned in letter b, a Government policy is needed so that the burden of taxes that would normally be paid by donors for this national disaster will be borne by the government;
d. that based on the considerations as mentioned in letters a, b, and c, it is necessary to promulgate a Regulation of the Minister of Finance on Income Tax Treatment of Humanitarian Assistance for the Natural Disaster in Nanggroe Aceh Darussalam and North Sumatra;
Bearing in Mind:
1. Law Number 6 of 1983 (Berita Negara [State Gazette] No. 3994 page 1B-20B ff) on General Provisions and Procedures for Taxation (Lembaran Negara [State Gazette] of the Republic of Indonesia for 1983 No. 49, Supplement to State Gazette No. 3262), as amended several times, most recently through Law Number 16 of 2000 (Berita Negara No. 6503 pages 1B-9B ff) (Lembaran Negara for 2000 No. 126, Supplement to LN No. 3984);
2. Law Number 7 of 1983 (BN No. 3995 page 1B-31B ff) on Income Tax (LN for 1983 No. 50, Supplement to State Gazette No. 3263), as amended several times, most recently through Law Number 17 of 2000 (BN No. 6506 pages 1B-7B ff) (LN for 2000 No. 127, Supplement to LN No. 3985);
3. Government Regulation No. 138 of 2000 (BN No. 6564 pages 1B-4B) on Calculation of Taxable Income and Payment of Income Tax During the Current Year (LN for 2000 No. 235, Supplement to LN No. 4055);
4. Presidential Decree No. 187/M of 2004 (BN No. 7128 p. 11B);
HAS DECIDED:
To promulgate this
REGULATION OF THE MINISTER OF FINANCE OF THE REPUBLIC OF INDONESIA ON INCOME TAX TREATMENT OF HUMANITARIAN ASSISTANCE FOR THE NATURAL DISASTER IN NANGGROE ACEH DARUSSALAM AND NORTH SUMATRA.
Article 1
Contributions made by Taxpayers for the purpose of humanitarian assistance for the natural disaster in Aceh Darussalam and North Sumatra that occurred in December 2004 may be charged as costs.
Article 2
The provisions needed for the implementation of this Regulation of the Minister of Finance shall be stipulated through Regulations of the Director General of Taxation.
Article 3
This Regulation of the Minister of Finance shall come into force on the date of its promulgation.
So that all persons may know of it, it is ordered that this Regulation of the Minister of Finance be announced through placement in the State Gazette (Berita Negara) of the Republic of Indonesia.
